Excerpt: “I’m friends with the local police; I could call them right now and probably get you committed if you were in Virginia,” [Attorney John] Whitehead [of the Rutherford Institute] said. “They can arrive at your door based on somebody’s testimony or your Facebook page and take you away to a mental hospital… There’s a system here that is corrupt. And this guy is caught in it.” Whitehead said that every year in Virginia more than 20,000 people are committed under similar circumstances and “that means a lot of people are disappearing” under the pretext of mental illness. Whitehead said that the posts cited as “terrorist in nature” were part of a private Facebook game called Illuminati that Brandon was playing with his brother and sister, which the government spied on.

Watchwoman’s Editorial: First, I should like to remind you of what I learned from my 6th grade teacher way back in the 50’s. He told us that the godless, religion-free “new world order” and “one world government” would be indomitably set in place by the year 2000 and it would resemble the Soviet Union and Red China’s communist governments and they would have become softer towards accepting the USA’s form of democracy-styled governance. He compassionately told us that it was his job and his heart-felt obligation to prepare us to receive it so that we wouldn’t be caught up on the wrong side. When we questioned him, “What happens to people who disagree?” He explained that they would be put in mental institutions and retrained with drugs and psychotherapy! Now for the other side of this story…While, I do not agree with what Brandon Raub wrote on Facebook since I have never thought that 9-11 was an inside job and have no quibbles with Building #7, the way the Towers fell, or that a plane, not a missile like the conspiracy theorists advance, was what hit the Pentagon. While, I would never write or say the things that Mr. Raub has written, nor do I approve of his saying them. God did not give the right to anyone to start shooting anyone for any reason. That right of life and death, justice and retribution, crime and punishment, was what God bestowed only to a fair and just government to enforce in the matter of due process and eventually even exercise the death penalty if necessary. However, our government is growing overbearing, far too fearsome and over the top, headed in a totalitarian direction for my comfort level, based upon the rights we have protected by the U.S. Constitution and the Amendments set up for us by our Founding Fathers. This makes this issue very troubling and causes me great concern for our liberty and freedom of speech in the USA. I am very grateful that the Rutherford Institute got involved and got this Marine vet out of the mental hospital where he was being held against his will. However, his entire life was interrupted and I’m sure it will cost Mr. Raub several thousand dollars in legal fees to have gotten back his freedom. I am very concerned for the direction this country is taking into the very dangerous pathway of stealing the rights granted to us by God Almighty that are supposed to be protected (not granted) by the U. S. Constitution. People today, because they have never been taught in schools or colleges, have no understanding of their inalienable rights and what that means – and why it is so important for our inalienable rights to be protected from an overbearing and intrusive government. We need churches to begin to teach adults and children in Sunday schools what the U.S. Constitution means and why our inalienable rights are basic fundamentals of Biblical doctrine and in agreement with the Authority of God over man, not man’s rights to be the dictators of men over which they exercise authority. Government must be in subjection to the righteousness of God’s Authority and God’s Law Word; otherwise, government will become the Pol Pot’s, the Hitler’s, the Stalin’s and Lenin’s over the people they are governing. Back in the 70’s an experiment was conducted with several college students. Half the group was the prison inmates and the other half were designated the guards. It was to last 14 days, but the guards became so abusive that it had to be halted after less than half that time. When a group is given absolute authority, it becomes very, very dangerous for the group that is their subjects. The primary problem with the college experiment was that the man who instituted the experiment also designated himself to be the “prison warden” and in his utter authoritarian position, he became willing to accept, if not even encourage, the uncalled for abuse by his “staff”. He lost his entire perspective by not being subject to any other authority. He essentially became the dictator and the whole experiment went sideways – and he couldn’t see it. Man needs God’s Authority with God’s Perfect Love and Righteousness formulating God’s Perfect Laws to Govern for mankind to survive our own grievous desires to be in utter control and dominate. ▬ Donna Calvin ▬ Tuesday, August 28, 2012

Chesterfield man held in hospital on concerns over Internet posts

A Chesterfield County man and Marine veteran is in a local hospital after being picked up by federal and local law enforcement officials concerned about threatening Internet postings.
Brandon J. Raub, 26, was in Hopewell’s John Randolph Medical Center on Saturday.
“I’m currently in John Randolph in the psychiatric ward being held against my will,” Raub said in a telephone interview.
Reports of his detention Thursday have gone viral on the Internet.
Raub said Secret Service, FBI and Chesterfield police officers came to his home Thursday. “They were concerned about me calling for the arrest of government officials,” he said.
He was taken to the Chesterfield police station and then to the hospital, he said.
“I talked to a Secret Service gentleman for 20, 30 minutes,” Raub said. “I was very cooperative and answered everything honestly.
“I really love America, and I think that idea that you can be detained and sent somewhere without due process and a lawyer … is crazy.”
Raub said he has been raising questions about 9/11 and signed a petition to reopen investigation of the terrorist attacks.
On Wednesday, Raub posted on his Facebook page, “The Revolution is here. And I will lead it.”
On Aug. 11, he posted: “I know many of you think I’m going crazy, and are wondering just why I have been posting the things I have been posting. I don’t have the energy to explain. Just know that a new beginning is coming.”
An Aug. 5 post said, “If you are unaware of the great amount of evil perpetrated by the American Government I suggest you take … your head out of the sand. The day of reckoning is almost at hand.”
And on Aug. 4, he posted, “I am standing against a great evil. I will do it all by myself if I have to.”
“Our office had received a complaint about threatening posts,” said Dee Rybiski, spokeswoman for the Richmond FBI office. “As we would do in any circumstance such as this, our office along with Chesterfield Police (Department) officers went to interview Mr. Raub.
“The FBI did not arrest him,” Rybiski said. “We are not commenting any further.”
Chesterfield police Lt. Rich McCullough said Saturday, “We were assisting the FBI in a matter. All we did was transport” him to John Randolph for medical evaluation.
According to Secret Service spokesman Max Milien in Washington, “That subject was not arrested by us on any charges.”
Raub said he served in the Marine Corps from 2005 to 2011 and was a combat engineer sergeant with service in Iraq and Afghanistan. He has a home silver numismatic-coin business.
Raub said he does not own a gun.

UPDATE:
Judge Orders Marine veteran detained over anti-government Facebook posts be released
UPDATE: A circuit court judge has ordered that the Marine veteran detained over anti-government Facebook posts be released from a state psychiatric hospital because law enforcement had no grounds to detain him, Catie Beck of CBS 6 News reports.
“This is a great victory for the First Amendment and the rule of law,” Rutherford Institute president John W. Whitehead said in a press release.
ORIGINAL: Brandon Raub’s attorneys have filed a motion to suspend the August 20 ruling that ordered Raub to be involuntarily admitted to a psychiatric ward.
On August 20 the 26-year-old Marine veteran was sentenced to up to 30 days in a psych ward after he was detained on August 16 in connection to Facebook posts that are critical of the official story regarding 9/11 and refer to “starting a revolution.”
Raub’s lead attorney, John Whitehead of the Rutherford Institute, told BI that the August 20 order was “rubber-stamped” and indicative of the corrupt system in Virginia.
“The special justice is very old,” Whitehead said. “He had trouble hearing Brandon. He brought into the courtroom a personal cassette player – we tried to listen to it and you can hardly hear what’s being said. This is the so-called judge – he’s a lawyer, not a real judge – it’s like what you would see in a bad movie.”
Whitehead said that every year in Virginia more than 20,000 people are committed under similar circumstances and “that means a lot of people are disappearing” under the pretext of mental illness.
“I’m friends with the local police; I could call them right now and probably get you committed if you were in Virginia,” Whitehead said. “They can arrive at your door based on somebody’s testimony or your Facebook page and take you away to a mental hospital… There’s a system here that is corrupt. And this guy is caught in it.”
In the motion Raub’s lawyers argue that since the initial orders to detain Raub did not follow the Virginia law that the Chesterfield PD cited, Raub’s initial and continued detention is unlawful.
“If they’re honest, he’ll be out early,” Whitehead said.
Chesterfield police stated that they “took Raub into custody for evaluation in accordance with Virginia State Code § 37.2-808 Emergency custody.”
But according to Va. Code § 37.2-808, a person in emergency custody may only be held for four hours unless a magistrate enters a temporary detention order (TDO) during that time.
Raub’s lawyers argue that since the magistrate entered the order more than eight hours after he was taken into custody, the District Court “lacked any basis (much less clear and convincing evidence) to conclude that Raub (i) has a mental illness, and (ii) that there was a substantial likelihood that, as a result of such mental illness, Raub will, in the near future, cause serious physical harm to others, as Va. Code 37.2-817 specifically requires.”
“The government’s power to involuntarily admit an individual for evaluation of a mental illness is a creation of statute. Because an order providing for such admission deprives a citizen of his liberty, to protect citizens from an overreaching government the Virginia legislature has created a specific, detailed procedure, set forth in Virginia Code § 37.2-800, that must be followed before an individual can be involuntarily admitted. In the present case, that procedure was not followed. As such, the District Court’s August 20, 2012 order is void.”
When asked about the motion directly contradicting the statement made by Chesterfield police, Chesterfield PD public information coordinator Elizabeth Caroon told us “As this is not a criminal matter, we have no further comment.“(Boy–they did not want to be near that stinking can of worms)
Beyond the “fatal procedural deficiencies,” Raub’s lawyers argue that the evaluations of Raub “utterly fail” to provide evidence that Raub is mentally ill and potentially violent, adding that any mention of Raub’s Facebook posts in the orders violates his First Amendment right to freedom of speech.
Whitehead said that the posts cited as “terrorist in nature” were part of a private Facebook game called Illuminati that Brandon was playing with his brother and sister, which the government spied on.
The motion states that at the very least Raub should be transferred from Salem to John Randolph until the appeal is heard because Raub is from the Richmond area, Salem is 188 miles away from Richmond and Raub’s lawyers need regular face-to-face access to Raub so that Raub can provide information and participate in his own defense.
Whitehead said that Brandon is “very calculated, very intelligent, very lucid” and that Brandon said his social worker is nice and doesn’t ask him much as they “chit-chat and drink coffee.”
“The best thing they can do now is say ‘We’re not going to charge this guy, we’re going away.’ But we’re not going to let this go away,” Whitehead said.
